Passenger in Oceanside Three-Car Pile Up with a Delay in Seeking Medical Treatment

He was on Vista Way in Oceanside and was stopped at a red light behind another vehicle‚ when his vehicle was rear-ended by a woman traveling directly behind him. Our client also visited an orthopedic surgeon to rule out surgery as an option. Following his injections and physical therapy‚ our client was again released from active care with an improvement in his symptoms.

Nationwide claimed that our client was not entitled to the full value of his medical bills because of the three month delay between the accident and when he first sought medical care‚ as well as the five month gap in treatment between when he finished treatment with the chiropractor and when our client went back for physical therapy and injections. In light of Nationwide’s decision not to tender policy limits‚ we filed a lawsuit and served the complaint upon the at-fault driver. Almost immediately thereafter‚ Nationwide offered policy limits of $50‚000 to settle our client’s case.
