CPSC Reports Sixth Nap Nanny-Related Infant Death

Despite a recall of some 160,000 Nap Nanny infant recliners that was issued on June 14, 2013, the U.S. Consumer Product Safety Commission (CPSC) has reported that another infant has died in the recalled baby seat.

The Nap Nanny Infant Recliner is a portable mattress that has the shape of a bucket seat. Infants were secured into the Nap Nanny via a three-point harness. However, the CPSC received numerous reports of injuries and deaths after children partially fell out of the seat and were found hanging over the side of the recliner. Some infants suffocated when they were trapped between the recliner and crib bumpers. There were also reports that infants strangled to death due to the harness or suffocated when they turned over on to their stomachs and were trapped against the fabric of the seat.

In December of 2012 the CPSC took the rare action of filing an administrative complaint against Baby Matters LLC, the manufacturer of the product. The owner had refused to voluntarily recall the product and denied all of the liability allegations.

After an agreement was drawn up with Baby Matters to recall the dangerous product six months later, the company went out of business. As part of the agreement though, Baby Matters agreed to leave its website online for five years in order to warn the public about the product.

The CPSC urges all parents who may still have a Nap Nanny to remove it them from their homes and discontinue use of the product. The defunct company is no longer accepting returns, so owners of the defective product are encouraged to seek full refunds from the retailers where the product was purchased.

The CPSC has stated that the safest place for a child is a bar crib or on his or her back without cushions or additional fabric materials surrounding the baby.

The Infant injury attorneys at the Jurewitz Law Group in San Diego urge parents to rid themselves of this dangerous product. This latest tragic death of an infant points out that parents and loved ones need to be informed about potentially deadly infant products and follow all recall instructions they receive immediately. Sadly, we are not aware if the parents in this latest incident even knew the item had been recalled.

We firmly believe that a manufacturer that produces infant products has a special onus to assure that its products are safe. If a defective product has injured your child, call us or contact us online to set up a free review of your case.
