On September 24, 2017, at 4:15 p.m., Mr. Erwin was riding in the front passenger seat of his car with his wife traveling northbound in San Diego, California at twenty-five miles per hour. As his wife approached the intersection, the defendant failed to acknowledge the stop sign and continued driving, colliding into the passenger side of our client’s vehicle. Mr. and Mrs. Erwin’s vehicle was rendered a total loss.

Following the accident, Mr. Erwin felt immediate pain in his left abdomen, his left shoulder, right ribs, back and head. After attempting to return home and treat his injuries on his own, his son took him to the emergency room.
