Slip and Fall Accidents

Slip and Fall Accidents

When conditions that allow a person to slip and fall exist, property owners are required to clean them up or clearly warn visitors. Failing to do this can result in preventable injuries.

Cracked Sidewalks

Cracked Sidewalks

The sidewalk outside of a property, be it a store, restaurant, or hotel, gets a lot of foot traffic. Because of this, it is important that it be in good condition, so visitors can walk safely.

Defective Staircases

Defective Staircases

It’s incredibly important that staircases be in good working condition. Faulty handrails, uneven steps, and inadequate landings can all lead to falls that can cause severe injuries.

Inadequate Lighting

Inadequate Lighting

Stores and shops should have enough lighting for a visitor to reasonably see where they are going. This includes outdoor areas such as parking lots.

Frequently Asked Questions about Premises Liability

Premises liability is the area of injury law that describes who is responsible if a person is hurt by a dangerous condition on someone’s property. Property owners, such as stores, hotels, and restaurants, have an obligation to make sure their premises are safe for visitors.

The most common example of premises liability is a slip and fall claim. If a person is seriously hurt because they slipped and fell while shopping in a supermarket, the supermarket can be held liable for their injuries.

The damages you may be entitled to claim depend on the circumstances in your case and the extent of your injuries. Damages may include past and future medical expenses, past and future lost wages, pain and suffering, and emotional distress.

In cases of malicious or egregious conduct, the jury may award additional punitive damages. These damages are designed to punish the defendant and deter similar conduct in the future. When a premises liability accident results in wrongful death, survivors are entitled to recover their economic losses caused by the death of a family member and emotional distress damages, based on loss of the decedent’s society, comfort‚ and care.

Property owners have a duty to maintain their property in a reasonably safe condition, or to at least give adequate warning of any hazards. Examples of dangerous conditions that could give rise to premises liability claims include:

  • Improperly stacked merchandise that can fall and cause injuries
  • Slippery floors due to recent cleaning or spills
  • Obstacles in walkways causing tripping hazards
  • Unsecured items that can fall off shelves
  • Defective or missing railings in stairways
  • Inadequately fenced swimming pools
  • Uneven pavement that can cause trip and fall accidents
  • Lack of adequate security resulting in assault or rape
  • Inadequate lighting
  • Exposed electrical wires
  • Hazardous materials not properly stored
