San Diego Nursing Home Abuse Victim Lawyers

Helping Victims of Nursing Home Abuse

According to the Centers for Disease Control and Prevention (CDC), more than 500,000 adults over the age of 60 are neglected, financially exploited, or abused every year in the U.S. With statistics such as these, it is no wonder that the decision to place an elderly loved one in a nursing home is a difficult and complicated one. Choosing a nursing home that will provide the appropriate level of emotional and medical support is easier said than done with the increasing awareness and fear of potentially placing the well-being of your loved one into the hands of untrained, inexperienced, or abusive healthcare professionals at a poorly managed and/or understaffed nursing home facility.

If you or a loved one has been the victim of nursing home abuse in Southern California, the experienced personal injury attorneys in San Diego at the Jurewitz Law Group can help you obtain rightful compensation for your injuries.

Types of Nursing Home Abuse

The National Center on Elder Abuse (NCEA) categorizes nursing home abuse into seven different types:

  1. Physical Abuse - Using force to physically injure or threaten a vulnerable elder;
  2. Sexual Abuse - Threatened, tricked, forced, or otherwise coerced sexual contact on a vulnerable older adult, including those who are unable to give consent;
  3. Emotional Abuse - Verbal attacks, threats, rejection, isolation, or other belittling actions that may cause a vulnerable older adult distress, mental anguish, or pain;
  4. Neglect - A caregiver's failure or refusal to provide for a vulnerable elder's safety and/or emotional or physical needs;
  5. Exploitation - Theft, fraud, neglect, or misuse of authority and/or use of undue influence to gain control over an elder's money or property;
  6. Abandonment - A caregiver's desertion of a frail or vulnerable older adult; and
  7. Self-Neglect - Inability or failure to understand the consequences of one's own actions or inaction, which may lead to harm or endangerment.

Nursing Home Abuse and Neglect Warning Signs

Because elders in nursing homes are dependent on others for their safety and care, it is highly unlikely that they would report incidents of abuse or neglect for fear of retaliation. This is why, in order to keep your loved one safe, it is important to be aware of the signs of abuse and neglect. This is also valuable knowledge when visiting nursing homes. If you observe any of the following warning signs while searching for a nursing home, then it not the right choice for your loved one; and if you observe these warning signs in your loved one, you must report it to the proper authorities:

  • Malnutrition;
  • Dehydration;
  • Slap marks;
  • Unexplained bruises;
  • Sudden change in accounts/finances;
  • Poor personal hygiene;
  • Altered wills;
  • Unusual bank withdrawals;
  • Dirty or tattered clothing;
  • Withdrawal from everyday activities;
  • Listlessness and fatigue;
  • Bruises around the genital area or breasts;
  • Unexplained sexually transmitted diseases;
  • Lack of medical or dental care;
  • Constant hunger/begging for food; and
  • Left unattended for long periods of time.

Protecting the Rights of Elders in San Diego

All nursing home residents are entitled to various rights under California's Health and Safety Code, including, but not limited to, visits, privacy, confidentiality, quality care, and clean, safe, and comfortable living accommodations. Unfortunately, many nursing homes hold profits above providing the best quality care and accommodations for their residents. This leads to understaffing, poorly trained staff, lack of administrative supervision/management, messy facilities, poor living accommodations, lack of day-to-day necessities and medical supplies, and even poor food quality or quantity. Such conditions are unacceptable, inexcusable, and, in fact, illegal.

If you or a loved one has been the victim of elder abuse or neglect, you may have the right to pursue civil action against the nursing home and any other at-fault individual parties. The dedicated San Diego lawyers with the Jurewitz Law Group are committed to obtaining justice and maximum compensation for neglected and/or abused nursing home residents.
