Failure to Perform and Fraud in Commercial Real Estate Sale
Our client purchased a commercial warehouse in Chula Vista from the prior owner who represented that the facility would be in broom swept condition and all commercial property would be removed from the property at the time escrow closed. Seller also agreed to a $500 per day penalty for failure to meet these obligations, which they, in fact, failed to meet.
We sued the seller for breach of contract and fraud. Before a court hearing, we obtained a judgment in favor of our client for over $500,000.
