El Cajon Woman Breaks Foot in Hit and Run Pedestrian vs. Car Accident
Our client was severely injured and left unconscious in the street after being hit by a car in an El Cajon pedestrian accident as she was crossing the street. The driver left our client in the street and drove her car to her apartment complex where she hid from law enforcement until she spoke with her relatives and finally turned herself in the next day.
By that time, our client had already been transported to the hospital and undergone one surgery to repair her severely broken and disfigured foot.
This again was one of those unfortunate cases where the irresponsible driver did not have enough insurance to pay for the damage she caused and our client and her family had very little insurance of their own to make up for the shortfall. In this case, we conducted an asset search and determined the policy limits for the hit and run driver. She only had the state minimum $15,000 insurance policy. Given these findings, we obtained the driver's insurance policy limits, made a claim against our client's parents' underinsured motorist (UIM) insurance policy, and also maximized the benefit through medical payment coverage.
