Man with part of cheek bitten off in jail suing San Diego County

SAN DIEGO, CA – San Diego County is being sued for allegedly failing to provide medical care and prevent an attack against an inmate in San Diego Central Jail last year that resulted in a man losing part of his cheek.

According to Fox 5 San Diego, the plaintiff, 26-year-old Miguel Lucas, claims that a deputy named Deputy Gustafson, among other unnamed individuals, failed to stop the attack that occurred on June 4, 2019, in which another inmate bit off part of the plaintiff’s cheek.

Lucas also claims that multiple officers posed and took photographs with the piece of his cheek after the fight and mocked his fighting prowess.

The plaintiff alleges that after the attack, a nurse purposefully failed to tend to his wounds, resulting in a scar and multiple infections.

The suit also alleges that the jail purposefully ignored a doctor’s consultation for a plastic surgeon after the attack, because the system did not want to pay for the specialist doctor, instead allowing him to become “permanently disfigured.”

Lucas claims that the attacker, Reginald Harmon, 35, was incorrectly placed in the main jail area instead of a mental health unit. This occurred despite the alleged attacker showing multiple violent mental health episodes, according to the suit. The lawsuit also claims that the San Diego Central Jail consistently failed to provide proper mental health care for its inmates over the years.

Lucas claims that despite filing multiple complaints, the paperwork “went missing” in an attempt at a cover-up.

The plaintiff reportedly filed a similar suit in December, but it was rejected a few months later.

Representatives from San Diego law enforcement gave no comment, reportedly due to the ongoing nature of the suit.
