An 85-year-old woman was killed in a San Diego crash after her car stalled in the far left lane of traffic. According to a news report in The Carlsbad Patch, the fatal car crash occurred along northbound 5 Freeway at Via de la Valle the morning of June 24. Officials say a 40-year-old man from San Diego struck her Nissan Sentra from behind with a Honda Accord. The driver of the Sentra was killed. The driver of the Accord suffered minor injuries. It is unclear what caused her car to stall or how much time the driver of the Accord had to avoid the crash.
There are many reasons why a car may stall on the highway. This is why it is important to regularly bring your vehicle in for checkups and to stay abreast of recent recalls and auto defects. If you believe your car is about to stall, you must try to get over to the side of the highway. Ideally, you will have time to get off the road and onto the shoulder. Use your turn signals to exit the roadway and then put on your hazard lights to let cars know you are in distress.
Often times, however, it is impossible to completely pull over onto the shoulder. If this happens to you, do not get out of your car. You should also never try to cross a highway on foot. Officials typically advise drivers to stay buckled in their car with their hazards on and wait for help.
When drivers fail to avoid stalled vehicles, a number of questions must be asked. Did the driver of the stalled vehicle attempt to move from traffic? Were the hazard lights on? How long did the approaching driver have to avoid a collision? Was the rear driver distracted, fatigued, speeding, or otherwise careless? The answers to these types of questions will help determine who was responsible for the crash and who should be held accountable for the injuries suffered.
If you have lost a loved one in a fatal San Diego car accident, it is important for you to explore your legal options. If your loved one was killed by someone else’s negligence, you may be able to seek financial support for your tragic loss by filing a wrongful death claim. A successful claim can result in support for funeral expenses, loss of companionship, pain and suffering, lost future wages, and other related damages.
