Fatal pedestrian accidents can occur at any time and at any location. If you are ever involved in an injury accident, it is your responsibility to remain at the crash site, to contact the authorities and to offer help to the victim if possible. It appears from the report that the driver involved in this tragic accident did the right thing by remaining at the crash site and speaking with the authorities.
If you have lost a loved one in a fatal San Diego pedestrian accident, you are not alone. According to the California Highway Patrol, 82 pedestrians were fatally injured in San Diego in the year 2012.
While every traffic death is tragic to the family of the victim, not all deaths qualify as wrongful under the law. Wrongful death is a legal phrase referring to fatal injuries caused by the negligence or wrongdoing of another. Therefore, the family of someone killed in a crash can file a wrongful death claim if they believe that someone else’s careless behavior contributed to their tragic loss.
