Pedestrian Injured in Escondido Intersection Accident

San Diego Pedestrian AccidentA man was seriously injured in a Escondido pedestrian accident when a vehicle struck him as he walked in a marked crosswalk. According to a news report in the Times of San Diego, the pedestrian accident occurred at Quince Street and Washington Avenue in Escondido. Officials say the man was walking north in the crosswalk when an eastbound Ford Focus struck him. He sustained serious injuries and has been listed in critical condition. The driver was not injured and has not yet been cited for the crash.

In general, pedestrians in San Diego who are legally crossing the road in a crosswalk have the right of way. According to California Vehicle Code Section 21950: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” Drivers who fail to yield to pedestrians can face citations for their negligence.

Furthermore, negligent drivers can be held accountable for the injuries they cause. If you have been hurt in a San Diego car accident, you can pursue financial support for your medical bills, pain and suffering, lost wages, the cost of rehabilitation, and other related damages. Therefore, you should keep detailed notes of the losses you have suffered and stay abreast of the ongoing investigation.

In order to receive fair compensation for your losses, you will have to prove that:

  • The at-fault driver was behaving negligently.
  • You suffered a physical, emotional, and/or financial loss.
  • The driver’s negligence contributed to your loss.

Make sure you have photos of the crash site, detailed notes regarding the cause of the crash, medical records documenting your injuries, and contact information for anyone who may have witnessed the crash. A skilled San Diego car accident attorney can review your case and help you determine if financial support is available for your losses.
