A 32-year-old active-duty Marine from Escondido was killed in a solo-vehicle crash that occurred on January 8, 2012, around 2 p.m. on State Route 76 (SR-76) on a rural road near Palomar Mountain. According to California Highway Patrol Officer Jim Bettencourt, the biker was riding a 2007 Ducati motorcycle east of Red Gate Road.
The marine lost control of his bike on a curving stretch and hit the metal guard rail after his motorcycle slid out from under him. He sustained critical injuries and was pronounced dead at the accident scene.
If it is found that there was a loss of control due to a vehicular malfunction, then the auto maker may be held liable for this accident. Meanwhile, the victim’s family members should immediately seek counsel from an experienced San Diego County motorcycle crash lawyer who would educate them about their legal rights.
The victim’s family members may file a wrongful death claim against the manufacturer to obtain compensation to funeral and burial costs, loss of anticipated earnings, loss of love, care and companionship, and other accident-related damages.
Our personal injury law office sends sincere condolences to victim’s family members.
