A 28-year-old father and his 6-year-old son were injured in a Vista car accident when a car struck them as they walked to school. According to a report in the San Diego Union Tribune, the pedestrian accident happened at Valley Drive near Monte Vista Elementary School in Vista. Officials say the man was holding the child’s hand while using when the crosswalk when the SUV entered the four way stop and hit them.
The child was airlifted to Rady Children’s Hospital with critical injuries. The father suffered serious but non-life-threatening injuries. The SUV driver remained at the crash site and isn’t suspected of driving under the influence of drugs or alcohol. It is unclear why she entered the intersection while the father and son were in the crosswalk.
California law requires all drivers to yield the right of way to pedestrians who are legally crossing the road while using a crosswalk. Under Vehicle Code Section 21950:
“The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”
Drivers who fail to yield the right of way can face citations from the police. At fault drivers can also be held financially responsible for the damages they cause.
