If You Are Injured on the Job, the California Workers Compensation Act Entitles You to Receive Medical Benefits and Lost Wages.
The California Workers Compensation Act is a "no fault" wage replacement system that pays injured workers, in San Diego and throughout the state, both medical benefits and lost wages during his time out of work.
Under the act, an injured employee gives up the right to sue his employer in court. In return, the employee
received compensation without having to prove fault, though the employer's liability is limited to benefits specified in the statute. Though this makes for a smooth process, the amounts the injured employee receives are almost always significantly less than what might be available if the employee could sue in court. There is no recovery for pain and suffering under this act. Though, in a number of cases, injured workers are not covered by the California Workers Compensation Act and may sue an employer in court.
At first glance, this "no fault" system seems just because injured employees will not have to go through the costly and time-consuming process of assigning blame. Though, it is no easy task getting employers and workers compensation insurers to come to an agreement, making this process intimidating and difficult to understand.
