SSI vs. SSDI: A San Diego Disability Claim Attorney Explains (Part B)
As you ponder SSI vs. SSDI, be advised that when you apply for either Supplemental Security Income (SSI payments) or Social Security Disability Income (SSDI), you'll need to meet some of the same requirements. For example, there must be medical documentation confirming that your mental or physical impairment will persist for more than a year and probably end when you're deceased.
If you meet the above requirement, that doesn't guarantee that you'll be approved for benefits. A San Diego disability claim attorney can explain that it's not uncommon for applications to be rejected.
SSI vs. SSDI: What They Have in Common
The medical impairments are practically the same for Social Security Disability Income and Supplemental Security Income.
SSI payments and SSDI payments are both contingent on your answers to these 5 questions:
- Are you currently working? If you're employed in 2011 and your monthly earnings exceed $1,000, it's unlikely that you'll be considered disabled.
- Do you have a "severe" condition? If your condition doesn't prevent you from working you won't be considered disabled.
- Is your condition a disabling condition? The Social Security Listing of Impairments contains conditions considered disabling. They include diseases and disorders affecting the major body systems. If your condition is listed, you'll be considered disabled. If not, it'll have to be determined whether you're disabled.
- Can you do the work you previously did? If your condition is considered severe, but is at a lower level of severity than the conditions on the Listing of Impairments, then it must be determined whether it really interferes with your work.
- Can you perform any other work? Your medical condition, age, work experience, education, and transferable skills will be taken into consideration to determine if you can perform any other work. If you can, your claim will be rejected.
