Q: My car was struck from behind my an uninsured motorist and I was injured in the San Diego, CA auto accident. I do not have uninsured motorist insurance. What can I do to collect compensation for my damages and injuries.
A: Just because the other driver was uninsured does not mean that your cannot sue him and collect damages. Insurance is just a pool of money that is available to pay for your damages if you are injured and is the first resource to be tapped by an injured person.
If the other driver is uninsured, the best option is to file an uninsured motorist claim with your own insurance company if you have that type of coverage. However, as is the case here, when you do not have uninsured motorist coverage, you can always sue the at-fault uninsured driver. In that case, since insurance is not available, your brother is hoping that the driver has sufficient income, savings, or assets to pay for the damages and injuries he caused.
