Q: My San Diego landlord allowed a broken sprinkler to leak water at the entrance of my apartment. I slipped and fell on algae that had grown in the water and broke my wrist. Is my landlord responsible for my injuries?
A: Your landlord may be responsible if he either knew or should have known about the broken sprinkler and growing algae after a routine inspection. Standing algae is known to be slippery and your landlord should have removed it from your front entrance. It could have caused injury to one of your guests or you--which it did.
So, did your landlord know about the water leak or algae? Did you tell him about it? If so, how did you tell him? Was it in writing or simply over the phone? If it was just over the phone and not documented, landlords usually claim they never received the complaint and it is sometimes difficult to prove that they are not telling the truth.
