Answers to Personal Injury, Wrongful Death, and Car Accident Questions

Q: I was involved in a car accident when the other driver ran a red light.  He is not from this country and does not have a California driver's license.  The car was rented by the company he was working for here in San Diego.  Can I still get my medical bills paid for and should I file a claim against the at-fault driver?

A: Assuming that the company he worked for insured his car, then he would be a permissive user of the vehicle and you can probably still receive compensation to pay for your lost earnings, medical bills, and pain and suffering.

Your claim would be against both the driver, who was actually at fault for the accident, and his employer, who took responsibility for its' employee while he was driving the car.  This claim is a little bit more complicated than most and you would be well served to consult with a personal injury attorney in San Diego.
