Answers to Personal Injury, Wrongful Death, and Car Accident Questions
Q: I was in a San Diego, CA auto accident and suffered an injury. Do I need a lawyer?
A: That depends on the extent of your injuries.
Most California personal injury lawyers will not tell you that in some cases you do not need a lawyer. In some cases, hiring a lawyer can actually take away from your net settlement proceeds and you could have obtained a better settlement by yourself. Those cases usually arise from car accidents that occur at low speed, do not have visible property damage to one or both of the vehicles involved, and/or the medical bills for treating your injuries will not total more than $2,500. In those cases, you may be better off handling your personal injury settlement yourself.
However, insurance industry studies have shown that--on average--personal injury clients with lawyers obtain settlements that are three times greater than injury accident clients who do not have an attorney. When you are involved in an accident and are injured, you probably need the help of a personal injury laywer if:
- There is any dispute as to who was at fault for causing the accident.
- Your anticipated cost for treating your injuries will exceed $2,500.
- You lose income because you have lost time from your job or you anticipate you will lose income in the future.
- The property damage to your vehicle and/or the other vehicle is visible to the naked eye.
