La Mesa Woman Breaks Kneecap After San Diego Trip and Fall
The Jurewitz Law Group represented a San Diego County probation officer from La Mesa who broke her knee cap after she tripped and fell over a garden hose that was stretched across the entrance way to a store in the Mission Gorge area of San Diego. The property owner knew that one of its' tenants used the garden hose and would stretch it across the length of the building to use in its' auto repair business. In so doing, it would stretch the hose across the entrance way to two other shops.
Despite the fact that the property owner knew that the hose was being used in such a way, our office had to fight two affirmative defenses: that the hose was not in itself a dangerous condition and that our client should have seen and avoided the hose as she walked in to the building. After an effective mediation, our office obtained a settlement of $39,000 for our client.
