South Africa Mountain Biker Attacked by Antelope

By Ross Jurewitz on October 17, 2011 - No comments

Biker Hit by Antelope17-year-old South African Evan van der Spuy was thrown into the air when a massive hartebeese antelope charged him at an estimated 30 mph in the bush lands of Kwazulu Natal. The teen was competing in a biking competition on October 9‚ 2011‚ when the buck came out of nowhere and plowed a hoof into van de Spuy’s head.

His partner from Team Jeep South Africa caught the freak bicycling accident on tape and called for immediate medical assistance after his teammate was hit.

Fortunately‚ the biker’s helmet absorbed most of the impact. Though‚ he did suffer a concussion and a fairly severe case of whiplash.

Van der Spuy will be forever known on YouTube as "the biker who got hit by a deer." Only in Africa would a bicyclist be taken out by 300-pound-plus antelope.

Cyclist Killed In Encinitas Hit-And-Run Bicycle Accident

By Ross Jurewitz on April 25, 2011 - No comments

James Steven Swarzman‚ 47‚ of Encino was struck and killed in a fatal Encinitas bicycle accident that occurred on April 10‚ 2011‚ around 1 a.m. near the intersection of North Coast Highway 101 and Jason Street. According to San Diego County Sheriff’s Deputy Yvan Rogers‚ Swarzman was travelling along with two other bicyclists when he was rear ended by a vehicle. According to the witnesses‚ the at-fault motorist was driving a blue Ford F-150 and fled from the scene after hitting Swarzman.

Swarzman was immediately airlifted to Mercy Air to Scripps Memorial Hospital for treatment where he was later pronounced dead. From the available facts‚ it is not exactly clear who bears the fault for causing this accident. Swarzman himself might bear some responsibility depending where in the road he was riding and under what circumstances. However‚ drivers are always required to be on the lookout for pedestrians and bicyclists using the road. At the very least‚ the negligent driver should have stopped and tried to help Swarzman. His recklessness and indifference not only led to the fatal accident that took Swarzman’s life but may have increased the likelihood of death by fleeing the scene.

Running from an accident scene cannot be ignored‚ both legally and morally. It is simply incomprehensible that someone would turn his back on such an incident and run away. Leaving the scene of a traffic accident is a serious violation under California law. California Vehicle Code 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person‚ other than himself or herself‚ or in the death of a person shall immediately stop the vehicle at the scene of the accident."

Swarzman’s family members should consult with an experienced bike accident attorney in San Diego to obtain compensation to pay for funeral and burial costs‚ loss of financial support‚ loss of love and companionship‚ and other accident related damages.

Our law office offers sincere condolences to all those who knew Swarzman for such a tragic loss.

Los Angeles Bike Accident Injures Rider | Car Accident Lawyer Attorney

By Ross Jurewitz on October 14, 2010 - No comments

An unidentified bicyclist in his early 20s suffered serious injuries in a bicycle accident that occurred on October 10‚ 2010‚ around 12:45 p.m. According to the California Highway Patrol‚ the bicyclist was struck by a minivan at the intersection of El Monte Avenue and Las Tunas Drive in Arcadia‚ approximately 115 miles from San Diego‚ in Los Angeles County.

Lt. Roy Nakamura said that the bicyclist suffered critical injuries and was transported to  Huntington Hospital in Pasadena for treatment. The police are investigating the exact cause of this San Gabriel Valley bike accident.

Based on this news report‚ it is not quite clear what caused this major injury bicycle accident. This particular intersection has traffic lights and clearly marked crosswalks. It is not clear‚ however‚ where the bicyclist was at the time of the car accident. Was he riding across the intersection? Was he walking his bike in a crosswalk? Did either the bicyclist or the motorist fail to yield right-of-way?

According to California Vehicle Code Section 21800 (a): "The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway." We trust officials are also looking into whether the van’s driver was intoxicated‚ distracted‚ speeding‚ or otherwise negligent at the time of the bike accident.

If the driver of the van is determined to have been at fault‚ then he or she could be held financially responsible for the injuries caused to the bicyclist. Injured bicyclist in this case could seek compensation to cover medical expenses‚ loss of wages‚ cost of hospitalization‚ rehabilitation and other related damages. Bicycle accident victims should contact an experienced Los Angeles bicycle accident lawyer‚ who will analyze all aspects of the incident and make sure that the negligent parties are held liable.

We hope and pray that the injured bicyclist did not sustain any life threatening injuries and that he recovers to his health completely.

Fatal Ramona Bicycle Accident | San Diego Bike Injury Lawyer Attorney

By Ross Jurewitz on September 15, 2010 - No comments

An unidentified 54-year-old bicyclist was struck and killed by a suspected drunk driver who later crashed his car into a parked car hurting three more people in Ramona on September 11‚ 2010 around 8:50 p.m.

Ramona Bicycle Accident AttorneyAccording to the California Highway Patrol‚ the bicyclist was crossing Main Street near Kalbaugh Street when he was struck by a SUV and thrown on the road.  The SUV swerved and struck a stop sign‚ went over an embankment‚ and hit a parked vehicle pushing it into a nearby liquor store.

Two people in the parked car complained of pain and one person suffered serious cuts by  flying glass. California Highway Patrol officers took the SUV driver to Palomar Hospital and later arrested him for suspected driving under the influence causing serious bodily injury.

This is an unfortunate‚ and completely inexcusable‚ incident in which‚ due to the negligent driving of an intoxicated driver‚ one bicyclist lost his life and several other people suffered injuries.   The SUV driver will probably be found to have violated California Vehicle Code Section 23152(a) which states that “It is unlawful for any person who is under the influence of any alcoholic beverage or drug‚ or under the combined influence of any alcoholic beverage and drug‚ to drive a vehicle.”  The bicyclist’s family‚ as well as the injured passengers in the car‚ should consult an aggressive San Diego personal injury attorney who could help them get a fair compensation for the irreparable loss.

We offer our deepest condolences to the bicyclist’s family for the tragic loss of their loved one and sincerely hope that the injured victims recover to their complete health soon.

Seattle Motorcycle Accident Attorney | San Diego Bike Crash Lawyer | Personal Injury Law Firm

By Ross Jurewitz on September 2, 2010 - No comments

In other parts of the country‚ with warmer weather‚ many choose to leave behind their everyday vehicle and enjoy the freedom of a motorcycle.  Here in San Diego‚ the weather is usually nice enough for a ride.   I understand the desire to ride a motorcycle as I too enjoy a nice summer day on a bike‚ but as a San Diego motorcycle accident attorney and personal injury lawyer I am also familiar with the grave risk motorcyclists subject themselves to daily.

With only a thin piece of material between themselves and the road it is no shock that bikers are 16 times more likely to die in an accident than other motorists. Some question why anyone would ever jump on a bike with these types of risk‚ but any biker will tell you the freedom and savings in gas outweigh the fear.

There are many different factors contributing to motorcycle accidents- potholes and road construction pose difficult for riders. Weather conditions also pose more of a threat while on a bike- imagine driving your car without windshield wipers in a sudden rain storm and without a sun visor when the sun is glaring. These difficulties that bikers encounter are easy to navigate through after a rider has attended a motorcycle training school. These courses teach the ropes of the road- how to navigating adverse weather and road conditions and protecting yourself from becoming a victim of a self-created accident. They also help riders learn to avoid collisions due to the inattention of other motorists by teaching the art of strategic avoidance. Sadly‚ in spite of the benefits of rider training 92% of bikers involved in accidents did not undergo formal training and instead relied on self taught skills or those learned from friends or family.

Just as with driving any vehicle proper training is essential to accident prevention‚ however‚ falling victim to an accident is always a possibility. If a motorcycle accident does occur there is information to help you through the process.

Seattle motorcycle accident lawyer‚ Jason Epstein provides the information you need in case you are involved in a motorcycle accident. On his site‚ Straight Talk Law you can find the book: The Truth About Washington Motorcycle Accidents. This book is FREE to Washington residents at the link above.

If you were involved in a motorcycle collision please do not wait to contact an attorney. If you are located in the San Diego or Southern California area please contact my injury accident law offices. If you are in the Seattle area‚ contact Seattle motorcycle accident lawyer‚ Jason Epstein.
