An unidentified bicyclist in his 30s or 40s was struck and killed by an SUV on May 31‚ 2011‚ around 6:20 p.m. between Camino Del Sur and Black Mountain Road in Rancho Penasquitos. According to California Highway Patrol Sgt. John Tyler‚ the female driver lost control of the SUV when she was trying to change lanes on Route 56 (SR-56). The SUV plowed through a grassy embankment‚ took down a chain-link fence‚ and then entered the bike path before landing on its side.
One bicyclist was pronounced dead at the scene. Another bicyclist also suffered critical injuries and was immediately transported to a nearby hospital for treatment. Both were wearing helmets. The female driver of the SUV also suffered injuries and was immediately rushed to a nearby hospital by the paramedics.
From the available information‚ it is unclear what made the SUV driver lose control and land hit the bicyclists from behind. It is believed that she was driving at freeway speed. Drug or alcohol usage has not been totally ruled out yet. If it is found that the SUV driver was speeding or driving recklessly‚ then she will be held liable for bicyclist’s wrongful death and the injuries suffered by the other bicyclist.
The bicyclists’ family members should immediately consult with an experienced San Diego bicycle accident lawyer who would hire a trained private investigator to find out how the accident occurred. However‚ if the loss of control was not the drivers’ fault‚ then even she may be entitled for compensation.
A North San Diego County bicycle accident attorney will make it easy for victim’s family members to obtain compensation to cover funeral and burial costs‚ loss of love and companionship‚ and other accident-related expenses.
