68-year-old Imelda Limon was struck and killed in a serious car accident that occurred on October 27‚ 2011,
around 5:30 a.m. at the 1300 block of North Melrose Drive in Vista. According to Medical Examiner’s Office‚ Limon was walking across the street when a 64-year-old motorist driving a Saturn Ion hit her.
Limon was pronounced dead at the scene. According to sheriff’s traffic Deputy Ron Halstead‚ Limon was clearly not in a marked crosswalk and was about 150 feet north of the nearest intersection when she was hit by the car.
Based upon a reading of Section 21950‚ it is quite possible that both the driver and pedestrian may be responsible for this deadly pedestrian accident. Because the pedestrian may not be 100% at fault and the driver 100% fault-free under their responsibilities set forth by California law‚ the family of the pedestrian may still be able to recover damages for the loss of their loved one in this accident.
