19-year-old Anthony Devaney was struck and killed in a tragic pedestrian accident that took place on May 1, 2012, around 10:15 p.m. in Lake Elsinore. According to Riverside County Sheriff’s Department, Devaney was crossing Lake Street half a mile west of Interstate 15 (I-15) when he was struck by an SUV.
The driver did not see Devaney in time to slow down. According to authorities, Devaney was wearing dark clothing and possibly ear-bud headphones.
Based upon a reading of Section 21950, it is quite possible that both the driver and pedestrian may be responsible for this deadly Lake Elsinore pedestrian accident. Furthermore, because the pedestrian may not be 100% at fault and the driver 100% fault-free under their responsibilities set forth by California law, the family of the pedestrian may still be able to recover damages for the loss of their loved one in this accident.
