A 63-year-old La Jolla man was killed in a serious rollover car accident that occurred on January 2, 2012, around 7:30 p.m. near Osler Street in Linda Vista. According to San Diego police, the Toyota Prius crashed into a tree and rolled over a few times on Genessee Avenue. Medical Examiner’s Office officials found motorist’s body partly outside the vehicle. Officers were unsure if the victim was wearing a seatbelt.
The car driver was immediately transported to Sharp Memorial Hospital to receive medical treatment where he was pronounced dead around 8:14 p.m.
If it is found that there was a loss of control due to a vehicular malfunction (sudden acceleration or brake system dysfunction), then the auto maker may be held liable for this accident. Meanwhile, the victim’s family members should immediately seek counsel from an experienced San Diego County car accident lawyer who would educate them about their legal rights.
The victim’s family members may file a wrongful death claim to obtain compensation against the car manufacturer to funeral and burial costs, loss of anticipated earnings, loss of love, care and companionship, and other accident-related damages.
Our personal injury law office sends sincere condolences to the victim’s family members.
