A motorist was killed in a PT Cruiser and semi truck accident that occurred on October 21 at about 8:30 p.m. in the Linda Vista area. Initial reports suggest that a fully loaded semi-truck heading on northbound 163 was hit by a PT Cruiser. Once the PT Cruiser hit the semi-truck, it was dragged for about 100 feet before the truck finally came to a rest.
San Diego Fire-Rescue crews untangled the black PT Cruiser that was stuck beneath the semi truck using heavy machinery and other tools. The roof and door both had to be removed to get the motorist out. The cruiser driver suffered fatal injuries and was pronounced dead at the accident scene. Our law office sends sincere condolences to the victim’s family members and friends for such a shocking loss.
Firefighters confirmed that the car driver was the only person present in the vehicle when this accident occurred.
It is undetermined whose fault it was, but it seems that the semi driver was taking precaution by going at a slow rate and using their flashers (hazard lights) for other drivers to see. No matter what led to this fatal accident, it is important for the deceased victim’s family members to get in touch with an experienced delivery truck attorney. Contacting an attorney will help determine exactly what legal claims the family can pursue and explain the necessary steps to go about it.
As trucks are larger in size than a regular passenger vehicle, collisions with a truck can turn out to be more severely damaging. Some typical factors that are involved when it comes to truck accidents include: vehicle speed, yielding the right-of-way, unsafe lane changes, tailgating, unsafe vehicle operations, driving while intoxicated, and distracted driving.
Our Linda Vista semi truck accident wrongful death lawyers have years of experience helping our clients recover compensation from damages. Even if the cause of the accident is undetermined, which is the case in this accident, contact us as (888) 233-5020 to discuss your best options.

When the driver of a commercial vehicle has been involved in an accident due to negligence‚ very often the company that employs him may be held liable. Numerous factors are taken into consideration to determine fault‚ but essentially the driver is considered to be under the authority of the employer.
A San Diego personal injury lawyer may ask the following questions to assist in determining liability:
- What is the driver’s relationship to the company? Is he an independent contractor?
- What is the nature of the company’s business?
- To whom did the driver report the accident/injury?
- Who in the company manages operations?
- Was the driver operating the vehicle under a state regulatory permit which has been granted to the company?
- Did the company assign a deadline for delivery of the goods?
- What employee records does the company keep?
- What records were kept of the vehicle in question‚ i.e. safety inspection‚ repairs‚ etc. Who gave the authority for these?
- Did the company direct the driver’s route? Was there a safer alternate route that could have been taken?
Liability in a commercial vehicle accident is not automatically assigned to the driver‚ even when it has been established that there was negligence. It is important to have an experienced San Diego personal injury lawyer who can assist you through the complexities of the law. Call Russ Jurewitz for a free evaluation of your case.

An unidentified Beaumont-Cherry Valley Water District employee was killed in a Beaumont commercial trucking accident that occurred on June 28‚ 2011‚ around 2:35 p.m. near Veile Avenue‚ south of 6th Street in Beaumont.
The truck driver was also hospitalized for an unrelated condition. There is very limited information on the accident. An investigation will be conducted to determine the cause of the accident‚ which points to negligence by the driver. The investigating officers need to determine whether the truck driver was speeding‚ distracted or was driving under the influence of drugs. If it is found that the truck driver was speeding or was driving negligently‚ then he and his employer may be held liable for victim’s wrongful death.
