Two Injured in Carlsbad Auto Accident | San Deigo Car Wreck Lawyer Attorney

Two motorists suffered serious injuries in a chain reaction car crash that occurred on October 20‚ 2010‚ around 4:45p.m in Carlsbad. According to Carlsbad Police officer Lt. Bruce May this North San Diego County auto accident occurred in the 4900 block of El Camino Real.

May said that a 61-year-old van driver lost control of his vehicle and crossed over into the oncoming northbound traffic. The van driver later struck a 24-year-old man driving a small pickup truck‚ which was then struck by a northbound SUV. A 39-year-old female driver driving that SUV was not able to avoid collision with the pickup truck at that time.

Both the van and pickup truck drivers suffered serious injuries in this multiple vehicle car accident.  The driver of the van was immediately airlifted to Sharp Memorial Hospital for treatment‚ while the pickup driver was transported to Palomar Hospital.  SUV driver fortunately escaped unhurt in this multiple vehicle auto accident.

Authorities are trying to determine the exact cause of this multiple vehicle traffic collision.  From the available information it appears that the loss of control of the van triggered this accident. What lead to loss of control is not clear. Investigating authorities need to determine whether the van driver lost control due to lack of sleep or was driving while intoxicated. Two Pedestrians Struck By A Car In Imperial Beach | San Diego Injury Lawyer Attorney

Two women suffered serious injuries when they were struck by a car while they were crossing the street in Imperial Beach on October 16‚ 2010‚ around midnight. According to the Imperial Beach Police‚ both the women in their early 20s were trying to cross northbound at 16th Street at Palm Avenue when a female driver of an Infiniti struck them.

San Diego Police Officer David Stafford said that the 24-year-old driver drove her car through the green light and struck the pedestrians as they were in the intersection. The injured pedestrians sustained serious head and brain injuries and suffered a broken leg as a result of this car accident. Stafford said that the Infiniti driver fortunately escaped unhurt. Drugs and alcohol are not believed to be a factor behind this traffic collision.

From the available information‚ the Infiniti driver may have violated California Vehicle Code Section 21950(a) which states that “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection”.   However‚ if the driver had the right of way due to having a green traffic signal‚ the pedestrians may have some responsibility for causing this injury accident.

The police are investigating why this car accident happened. Pedestrian Killed in Rancho Penasquitos Hit and Run Auto Accident | San Diego Injury Lawyer Attorney

An unidentified man was fatally struck and killed by a hit and run driver on October 19‚ 2010‚ around 2:50 a.m. on State Route 56 (SR-56) on the Black Mountain Road in the Rancho Penasquitos area of San Diego. According to the California Highway Patrol officers‚ a pedestrian was struck by a car on the roadway and after hitting the victim the car driver fled away from the accident scene. The pedestrian was walking along the onramp to the freeway.  It is unknown why he came to walk in the lanes of traffic when he was hit.

Authorities investigating this San Diego auto accident located a red  Nissan Sentra a short distance from the traffic accident scene which is believed to be the vehicle that hit the victim.  One lane from  Rancho Penasquitos to SR-56 was shut down for several hours by the California Highway Patrol officers after the collision.

The police are on the lookout for the hit-and-run driver. The Blazer’s driver‚ Favy Zamora‚ was travelling with her son at that time.  Fortunately both of them didn’t sustain any injuries. Lodi Police Department Officer Brannon Haro said that it is believed that the Jetta miscalculated the distance and speed at which the Blazer exited the parking lot.

Traffic on West Lockeford Street remained blocked for an hour between North Hutchins Street and North Pleasant Avenue until the emergency crew could clearthe road.

Anaheim Auto Accident Kills Two | Orange County Injury Lawyer Attorney

Marta Barnard‚ 86‚ and Douglas Robert McFarland‚ 25‚ were killed in an Anaheim auto accident that occurred on October 11‚ 2010‚ around 11:33 p.m. According to the California Highway Patrol‚ a SUV crashed into a BMW‚ disabled due to an earlier crash‚  on westbound State Route 91 (SR-91‚ 91 Freeway)‚ just west of Brookhurst Street in Orange County‚ approximately 90 miles north of San Diego.

Anaheim Car AccidentBarnard was a rear passenger in a 2005 Nissan Murano while McFarland was driving a BMW.  The disabled BMW was facing toward the right shoulder of the road as a result of a preceding crash‚ when the speeding Nissan crashed into it. California Highway Patrol officers said that no other vehicle was a part of this fatal car accident.

According to the news reports‚ the Nissan driver made an attempt to stop the car but failed and hit the right side of the BMW. McFarland was pronounced dead at the accident scene while Barnard was rushed to Anaheim Regional Hospital for treatment. Barnard was later pronounced dead at the hospital.  The driver of the Nissan and a passenger sitting in the front suffered serious injuries and were transported to UCI Medical Center for treatment.

From the facts of the story‚ it is believed that the Nissan driver’s negligence or inattentiveness lead to this fatal Orange County car accident that took two lives.  Investigating officers need to determine whether the Nissan driver was distracted or was driving under the influence of any alcoholic beverage or drug. Los Angeles Bike Accident Injures Rider | Car Accident Lawyer Attorney

An unidentified bicyclist in his early 20s suffered serious injuries in a bicycle accident that occurred on October 10‚ 2010‚ around 12:45 p.m. According to the California Highway Patrol‚ the bicyclist was struck by a minivan at the intersection of El Monte Avenue and Las Tunas Drive in Arcadia‚ approximately 115 miles from San Diego‚ in Los Angeles County.

Lt. Roy Nakamura said that the bicyclist suffered critical injuries and was transported to  Huntington Hospital in Pasadena for treatment. The police are investigating the exact cause of this San Gabriel Valley bike accident.

Based on this news report‚ it is not quite clear what caused this major injury bicycle accident. This particular intersection has traffic lights and clearly marked crosswalks. It is not clear‚ however‚ where the bicyclist was at the time of the car accident. Was he riding across the intersection? Was he walking his bike in a crosswalk? Did either the bicyclist or the motorist fail to yield right-of-way?

According to California Vehicle Code Section 21800 (a): "The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway." We trust officials are also looking into whether the van’s driver was intoxicated‚ distracted‚ speeding‚ or otherwise negligent at the time of the bike accident.

If the driver of the van is determined to have been at fault‚ then he or she could be held financially responsible for the injuries caused to the bicyclist. Deadly Los Angeles Motorcycle Accident in Downey | Injury Lawyer Attorney

A Los Angeles car accident on October 8‚ 2010 believed to be caused by a suspected drunk driver led to the death of Sergio Rios Padilla‚ 23‚ who was riding his motorcycle at the time. This fatal Los Angeles County motorcycle accident occurred at the intersection of Paramount Boulevard and Florence Avenue‚ according to Downey Police Lt. Phil Rego‚ approximately 118 miles north of San Diego.

It is believed that Daniel Sokyra‚ 31‚ was driving a GMC pickup truck when he ran a red light and struck Padilla in the middle of the intersection. Padilla suffered major injuries as a result of the traffic collision.  He died shortly thereafter due to his fatal injuries.  Sokyra was arrested and booked on suspicion of felony drunken driving causing serious injury.

Based upon the evidence collected at the scene of this Los Angeles County traffic accident‚ Sokyra was driving his truck under the influence of alcohol when he ran a red light. California Vehicle Code Section 21453 (a) states: "A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or‚ if none‚ then before entering the intersection‚ and shall remain stopped until an indication to proceed is shown." In addition‚ California Vehicle Code Section 23152(a) states: "It is unlawful for any person who is under the influence of any alcoholic beverage or drug‚ or under the combined influence of any alcoholic beverage and drug‚ to drive a vehicle."  Where a driver violates these laws and causes a major injury‚ such as a broken bone or an injury that requires a surgery‚ the drunk driver may be charged with felony driving under the influence of alcohol causing serious injury.

In this case‚ the Padilla family may file a wrongful death claim against Sykora.  Some may ask what is the point; Padilla is dead and a lawsuit will not bring him back.  Without bringing a wrongful death lawsuit‚ Sokyra escapes full responsibility for his actions.  In addition‚ the Padilla’s have incurred a great deal of monetary and non-monetary damages as a result of their tragic loss.  While not completely fixing the problem created by Sokyra’s negligence‚ the claim could compensate them for medical and funeral expenses‚ lost future income‚ loss of love and companionship‚ and other related damages.
