Child Killed by Gangmember at Apartment Complex--Confidential Six-Figure Settlement
Our client’s child was shot and killed early in the morning on his way to school inside their Southeast San Diego apartment complex.  The gangmember was found, convicted, and sentenced to life in prison without parole.  Our office investigated and found that the murderer entered through a gate that was supposed to be locked and secured but whose lock had been destroyed for months.  We also found that gangs frequently loitered in the complex and police were called weekly for some type of gang disturbance.  With this information, we obtained a confidential six-figure settlement against the apartment complex and the management company for their negligence (the murderer still being the overwhelmingly responsible party).

Jet Ski Collision with Head Injury--Confidential Six-Figure Settlement
Our client was struck by a jet-ski while being towed behind a neighbor’s boat in Mission Bay in San Diego.  The client was transported to the hospital from the scene with massive closed head injuries and water ingestion.  We investigated the jet-ski operator and jet-ski owner—both of whom did not possess any insurance or assets to pay for the damages (insurance is not required for jet-ski operation).  Not accepting this as a final answer, we obtained cash settlements from these parties’ personal assets and a confidential six-figure settlement from the boat operator for failure to observe a proper lookout and warn other vessels of a person in the water.

Crush Injury to Foot--Partial Settlement of $337,500
Our client was a 13 year-old girl who had her foot crushed when a retaining wall between two apartment complexes fell on top of her.  Her foot required several surgeries and skin grafts to replace skin on her foot that had been damaged.  Our investigation indicated that the wall fell over for several reasons, including a palm tree located close to the wall which caused the wall to lean out.  At mediation, our office obtained a settlement of $337,500 from one of the apartment owners.

Legal Malpractice / Fraud on Client--$225,000
Our client was a San Diego office lighting company that was represented by another lawyer for a lawsuit against their insurance company.  That lawyer obtained a partial settlement of $225,000, which was deposited into his client-trust account.  However, the lawyer then stole the money and used it for himself.  Although the lawyer repaid $75,000 to our client, he failed to repay the rest.  We sued the lawyer and obtained a judgment in Superior Court for $380,000, including $250,000 in punitive damages.  The lawyer then filed bankruptcy to try to avoid payment of the judgment.  We brought in bankruptcy co-counsel and forced a negotiated settlement in bankruptcy for an additional $225,000.

Mold Infestation in Condominium--$119,923.51
Our client was an elderly woman whose new condominium had been flooded from water above her unit resulting in mold growth.  Our client started experiencing asthmatic reactions and allergies to mold.  There was significant dispute whether the water leak existed before she bought the condominium, whether it came from the water pipes owned by the homeowners’ association, or a leaky water heater in the unit above.  We sued the real estate brokers, homeowners’ association, the prior owner of the condominium, and the owner of the unit above and obtained a settlement at mediation of $111,923.51.

Car Strikes Children Crossing the Street--$100,000
Our clients were young girls who were struck by a moving car while crossing the street.  Both girls flew up into the air, landed on their head, and suffered fractures and dental injuries as a result.  They approached our office after 2 other lawyers had turned them down after learning that the driver did not have any insurance at the time of the accident.  We took the case on and prosecuted their case against the driver and her husband, obtaining a settlement of $100,000 from their personal assets.

Car T-Boned by Tow Truck (Red Light Dispute)--$97,500
Our client was driving early in the morning on her way to take care of her grandchildren.  She approached an intersection where she was “t-boned” by a tow truck making a u-turn.  Both drivers claimed to have a green light at the intersection.  Our client’s left hip became painful following the accident and she underwent hip replacement surgery.  At mediation, our investigation of the accident and work-up of the case resulted in a $97,500 settlement for our client.

Rear-end Car Accident--$65,000
Our client was injured in a rear-end car accident while stopped at a stop sign.  She had persistent pain and discomfort in her neck and back limiting her from her business and incurring over $20,000 in medical bills.  Mediation did not resolve this case and we prepared for trial.  However, a month before trial our office was able to obtain a $65,000 settlement for our client.

Trip and Fall at Supermarket--$55,000
Our client slipped on detergent that had leaked on a Supermarket floor.  The property owner knew of the spill but had not marked it with warning signs or attempted to clean up the spill.  Our client had 2 knee surgeries to repair her injured knee.  Our office was able to obtain a $55,000 settlement at mediation for our client.

Broken Ankle from Trip and Fall--$47,500
Our client tripped and fell, breaking his ankle, while walking down a well worn path from the street sidewalk to a shopping mall parking lot.  Our office investigated the area and found that the path had existed for some time and that the property owner knew people used it to access his property.  Based upon this information, we obtained a $47,500 settlement in addition to the workers’ compensation already provided to the client.
